Disciplinary Board

Disciplinary Board (Article 17 of the Statute)

  1. The Disciplinary Board is responsible for conducting the investigative phase of disciplinary proceedings against professors and researchers and for issuing a final opinion on the proposal submitted by the Rector, both with regard to the disciplinary relevance of the facts and to the type of sanction to be imposed.
  2. It is composed of three full professors, one of whom serves as chair, two associate professors and two researchers, all tenured and employed on a full-time basis. Active voting rights are granted, according to the principle of peer representation, respectively to tenured full, associate and researcher staff in service at the Politecnico. The members of the Board are elected by secret ballot, following the publication of a public notice on the University website for at least 15 days inviting eligible professors and researchers, tenured and full-time, serving at the Politecnico or at other Italian universities, to express their willingness to stand as candidates. For each category of members, an equal number of alternate members are elected to replace the regular members in the event of impediment or absence. In the absence of a sufficient number of candidates, the Academic Senate shall proceed to appoint, on the Rector’s proposal, the professors and researchers necessary to constitute the body. The members are appointed by Rectoral Decree, serve for three years, and may be renewed only once. The chair, in the event of absence or impediment, is replaced by the most senior professor by rank. In the event of equal seniority in rank, the older professor prevails.
  3. The Board operates according to the principle of peer judgment, acting only with the presence of members whose rank is at least equal to that of the person subject to the proceedings, in compliance with the principle of adversarial proceedings.
  4. The initiation of disciplinary proceedings is the responsibility of the Rector who, for any matter that may give rise to the imposition of a sanction more severe than censure among those provided for by Article 87 of the consolidated text of the laws on higher education referred to in Royal Decree No. 1592 of 31/8/1933, shall, within thirty days from the time the facts become known, transmit the documents to the Board, formulating a reasoned proposal. If the disciplinary proceedings concern the Rector, disciplinary authority rests with the Dean of the University. Where the disciplinary proceedings concern a member of the Board itself, that member is suspended from office until the proceedings are concluded and shall forfeit office if a sanction is imposed on them.
  5. The Disciplinary Board, having heard the Rector or a delegate thereof, as well as the professor or researcher subject to disciplinary action, possibly assisted by a trusted counsel, shall, within thirty days, issue an opinion on the proposal put forward by the Rector, both with regard to the relevance of the facts from a disciplinary standpoint and with regard to the type of sanction to be imposed, and shall transmit the documents to the Board of Directors. The Board of Directors, without student representation, shall, within thirty days of receipt of the opinion, impose the sanction or order the closure of the proceedings, in accordance with the binding opinion issued by the Disciplinary Board. The proceedings shall lapse if the decision referred to in the preceding paragraph is not taken within one hundred and eighty days from the date on which the proceedings were initiated. This period shall be suspended until the Disciplinary Board or the Board of Directors is reconstituted, in the event that the operations preparatory to its formation are under way and prevent its proper functioning. The period shall also be suspended, no more than twice and for a period not exceeding sixty days for each suspension, where the Board considers it necessary to obtain further records or documents for investigative purposes; the Rector shall give effect to the investigative requests made by the Board.
  6. Participation in the Board does not give rise to the payment of fees, emoluments, allowances, or reimbursement of expenses.
